REPORT of the ADMIRALTY, under Act 11 & 12 Vict. c. 129.
 
38.-Wicklow Harbour (Amendment of Act) Bill.
 
THEIR Lordships did not consider it necessary
to order a local inquiry in this case.
 
The object of the Bill is to amend
the present Harbour Act, 5 & 6 Vic. c. 3,
which in consequence of fixing the qualifications
of Commissioners too high, has been inoperative.
 
It is therefore proposed to repeal sections 1 to 21
inclusive (excepting 16 and 20),
relating to the election of Commissioners,
and to substitute a body of 12 Commissioners,
eight of whom are to be ex-officio members,
the remaining four Commissioners are to be elected
from persons resident in the county of Wicklow,
and rated to the poor in the annual sum of 20 l.,
or who shall be a registered shipowner residing in the said county,
and trading to or from the harbour of Wicklow.
 
It is not stated how eight Commissioners
to represent the town of Wicklow are to be elected,
and an addition is therefore required to Clause 7,
to define the mode of election.
 
Clause 8 requires, in addition,
that the amount of tonnage necessary to qualify, should be named.
 
Clause 10 appears unnecessary,
as the case is provided for in the Commissioners Clauses Act,
which is incorporated.
 
Clause 11 stands in lieu of Clause 140 in the original Act,
which limits the term of lease of wharfs, &c. to three years;
if more limit is necessary,
it would seem that a period of 14 years
would afford sufficient time and opportunity
for the lessees to derive benefit for outlay
of their capital on the premises.
 
The Harbours, Docks, and Piers Clauses Act 1847,
should also be incorporated.
